SOUTH AFRICAN COMPETITION COMMISSION APPOINTS HEAD OF CARTELS DIVISIONS

The Competition Commission (the “Commission”) has appointed Advocate Oliver Josie as the head of its newly established Cartels Division. The Cartels Division will investigate contraventions of the Competition Act constituting restrictive horizontal practices (principally price fixing, market division and collusive tendering).

In order to facilitate compliance with the Consumer Protection Act, 2008 (“the CPA”), the transitional provisions found in Schedule 2 of the CPA allow for the implementation of the CPA in a staggered process. The CPA has, for want of a better description, two ‘implementation dates’.
