Khurshid Fazel is a director in the Banking and Finance Team. She obtained her B Proc (cum laude) and LLB (cum laude) (Moritz Bobbert award for top LLB student) at the University of the Free State. She then went on to obtain her LLM (corporate law) at the University of Johannesburg whilst completing her articles at a large law firm. She was admitted as an attorney and notary in 2001 and practised in the commercial litigation department for the first few years of her career. She then changed her area of specialisation in about 2004 and moved to the finance team where she was trained and mentored by Ludwig Smith. During this time she also completed her LLM (tax) at the University of Witwatersrand
She joined another large law firm as a director in 2007 where she remained until she joined Bowman.
Khurshid has significant experience in preference share funding, acquisition finance, asset-backed finance, leverage finance, debt restructuring, structured finance, project finance and formation of and advising private equity funds. She has recently started diversifying into derivatives based work. She has been rated as a Tier III finance lawyer in the telecommunications sector by Chambers Global.
Outside of South Africa, Khurshid has set up private equity funds in Mauritius and advised on finance transactions in Nigeria, Abu Dhabi, Uganda, the Democratic Republic Congo, Tunisia, Zambia, Zimbabwe, Mozambique and Kenya.
Some of the major transactions that Khurshid has worked on are: setting up the Pan Africa Infrastructure Development Fund ( the largest infrastructure fund by commitment size in Africa); advising Eskom (the South African utilities provider) with regard to a R60 billion loan lent by the South African government to Eskom, advising the Main One (as the borrower) on the funding of the construction of the undersea fibre optic cable on the West Coast of Africa, acting for McDonald’s in respect of the sale of its South African interest to Shanduka, advising the Zambian government on the first public private partnership in respect of the Zambian National Toll Roads Project.
