Topics

Section 197 of the Labour Relations Act provides for the automatic transfer of employment contracts between employers where there is a transfer of a business as a going concern. What constitutes a “going concern” transfer has been a hotly debated topic since the LRA came into force in 1995. Most recently, the Constitutional Court considered this question in the context of the cancellation of service contracts and held that these circumstances may result in the application of section 197. This may have far-reaching consequences for clients tendering for work.

Chris Todd will consider these consequences and provide suggestions on what to consider when tendering for the provision of services, or when terminating a service contracts.

John Brand, leading mediator, has analysed the statistics from the 2011 strike season and he will share his insights into the 2011 negotiations, what went wrong and what could have gone better.
