Bowman Gilfillan offers insurance expertise in both the dispute resolution and corporate departments, and we can wherever appropriate draw on the expertise in our other departments, such as Employee Benefits, Maritime, Property and Employment Law.

Our attorneys are proactive in conducting and resolving disputes in the best interests of our clients and we emphasise the need to resolve matters as efficiently as possible

In the dispute resolution area we have over the years represented both insurer and insured in a wide variety of matters. The depth of experience of our dispute resolution attorneys is of invaluable assistance in dealing with all forms of insurance disputes and in accessing appropriate experts.

Our team of commercial litigation specialists is well placed to analyse disputes and identify creative solutions, and to prevent disputes from escalating to the point where they have to be resolved by a court. If court-based litigation is ultimately unavoidable, our approach is to try to resolve any disputes in a cost-effective manner that is aimed at generating results which are commercially appropriate to our clients' needs.

On the construction and engineering side, we advise on contractor’s all risk insurance, professional indemnity insurance, assets insurance and plant or other project-specific insurance that may be required on a particular project.

On the maritime side, we are listed correspondents for most of the International Group Protection & Indemnity Clubs and provide a comprehensive service ranging from ship casualty response to claims and defence matters. We also regularly act for Hull & Machinery underwriters by providing an emergency response to maritime casualties, including collisions, groundings, engine breakdowns and salvage.

We are used by a number of overseas firms as a local correspondent in insurance disputes before our courts.

On the commercial side, we advise on the formation and restructuring of insurance companies, formation of cell captives, drafting of policies and service level agreements and all other forms of general corporate advice that may be required by insurers. We also advise on regulatory compliance issues and have assisted a client with a regulatory compliance review of its insurance arrangements in several neighbouring countries.

For additional information on our expertise see the comments on our Alternative Dispute Resolution, Benefits, Corporate & Commercial, Litigation and Maritime practice areas.
