uring recent weeks several raids were done in Joburg CBD focusing on shops, storages and warehouses. On the 9th of February, the BP team, Customs and Metro Police raided Bimo Shopping Centre in Bree street. Whilst trying to gain entry into the first and second floor, counterfeiters were seen moving products and throwing the products into the courtyard. More than 40 shops were opened by breaking the locks and huge quantities of counterfeit brands were seized which included approximately 3000 Nike products and 10 000 Nike labels and quantities of Umbro soccer jerseys.
NEW TRADE MARK LEGISLATION IN INDIA NOW PROVIDES FOR SERVICE MARK PROTECTION IN CLASSES 35 TO 45

Trade Mark legislation in India has recently (as of 1 July 2010) been amended to adopt the 9th Edition of the Nice International Classification System. The changes brought about by adopting the 9th Edition are that class 42 has been divided by adding a further three classes, i.e. classes 43, 44 and 45. The services previously included in class 42 may now fall either in classes 42, 43, 44 or 45. The question arises as to how this will impact on existing applications and registrations in class 42.

UGANDA: A NEW ACT BRINGS ABOUT CHANGE - SERVICE MARKS NOW AVAILABLE

Relevant legislation did not provide for registration of service marks in Uganda. This situation has now changed as Uganda has assented to a new Act, No. 17 of 2010 (the Act) published in the Official Journal of 3 September 2010.
The 9th Edition of the International Nice Classification system has been adopted and service mark protection can be sought in classes 35 to 45.
