dispute resolution (litigation, arbitration, alternative dispute resolution and
mediation)

We currently act for several major clients in the banking, mining, insurance, construction and other business sectors, and have done so for many years.

We are recognised by many foreign firms as being able to provide excellent service to them in South Africa and are therefore regularly briefed by those firms to handle their clients’ dispute resolution in this country.  We have, over the years, built solid relationship with many foreign firms in exchange, thus enabling us to provide the best possible service to those of our clients who need dispute resolution expertise or support abroad.  With the development of the firm’s Africa Group, we are able to offer a broad scope of legal services to support our dispute resolution and arbitration lawyers in proceedings elsewhere in Africa.

We render professional, quality legal advice across most areas of law, and our team of lawyers has particular experience in aviation, banking, constitutional law, construction and engineering, mining, insolvency and debt recovery, insurance, IT, intellectual property, medical negligence, family law, forensic services and white collar crime and other general commercial fields.  We advise clients on the protection of confidential business, technical, scientific and research information.  We have worked closely with clients in regard to disputes before regulatory bodies including the Johannesburg Stock Exchange (JSE), Securities Regulation Panel (SRP), Gauteng Gambling Board and the Health Professions Council of South Africa (HPCSA).

banking and insurance

We have acted for one of the major banks in South Africa for over one hundred years.  We also represent several other financial institutions and insurance companies.

construction, engineering and mining

We have successfully represented many prominent construction and engineering companies and mining houses in dispute resolution and arbitration proceedings both in South Africa and beyond our borders.

intellectual property

Through our Intellectual Property Department we offer a full range of IP services.  Our IP litigation team has particular expertise in enforcing intellectual property rights such as patents, trade marks and copyright and in the prevention of counterfeiting.

due diligences

Our dispute resolution lawyers are ideally placed to provide due diligence services across all areas of commerce and industry.

Whenever necessary, we work closely with attorneys in departments of Bowman Gilfillan having other specific areas of expertise that may relate to litigious disputes, such as the Environmental Law, Administrative Law, Employment Law and Property Law departments, thus ensuring that our clients receive specialised advice from all appropriate areas of expertise within the firm.

white collar crime

Our approach to forensic investigations aims to reduce, control and prevent business related or white collar crime, such as fraud and false pretences, theft, breach of trust, offences against the Government, the corruption of public officials, the insolvency process, securities fraud and counterfeiting.

Our team is particularly knowledgeable and experienced in the applicable law of evidence and investigative legal procedures, and possess the necessary interrogation and world class litigation skills not only to investigate but also to institute civil, disciplinary or criminal proceedings and recover whatever losses may have been sustained.  Members of the team have been certified as fraud examiners by the Association of Certified Fraud Examiners.

Pro Bono work by lawyers | attorneys in South Africa
Bowman Gilfillan is proud to be one of the first large commercial firms to develop and implement a comprehensive pro bono policy.  In accordance with this policy we pursue meritorious public-law cases and act for indigent clients in a number of ongoing matters.  As a responsible corporate citizen, Bowman Gilfillan encourages its practitioners to seek to provide legal services to deserving organisations and individuals on a pro bono (free) basis.  A number of pro bono matters have been taken on in a wide variety of fields, from education to healthcare and other social services and partnerships have been established with recognised public interest legal services providers such as the Legal Resources Centre and the Aids Law Project.

Bowman Gilfillan has also entered into an arrangement with CIDA City Campus, particularly in business subjects, in terms of which we prepare the lecture materials for, and present lectures to, their second year students.  We also provide CIDA with legal advice. All of this is done free of any charge, as part of our social responsibility programme.
