Basic Conditions of Employment Act, No. 75 of 1997

In accordance with a recently released determination by the Minister of Labour, with effect from 1 July 2011 the earnings threshold for the purposes of the Basic Conditions of Employment Act, No. 75 of 1997 (“the BCEA”) will be increased from R149,736 per annum to R172,000 per annum.

On 17th December 2010 the Minister of Labour published four Bills in the Government Gazette. The Bills propose amendments to a range of employment laws. Members of the public were given until 17 February 2011 to comment on the Bills. Although the purpose of the proposed amendments to the law and their effect is not clear in many respects, we think it important to give clients a quick overview of what is envisaged, particularly because the Bills have already been the subject of much speculation and at times misleading reporting in the public media. We will be running a client seminar on 2 February 2011 for those clients who want to examine the proposals in more detail. This briefing note is intended to give an overview only.

Labour Law Amendments

The Bills may not always achieve all their intentions because there are drafting problems in certain important areas. These drafting problems might also cause possible unintended consequences. The public is given until 17th February 2011 to comment on the Bills and Bowman Gilfillan will arrange seminars in the second half of January 2011 to explain their content and to explore their legal implications.
