Following on from our newsflash dated 21 October 2009, in which we highlighted the possibility of obtaining security in South Africa as an alternative to Rule B attachments, Bowman Gilfillan offers a free “port watch” service to clients who are searching for target vessels. The scope of the service covers the Ports of Durban, Cape Town, Saldanha Bay and Richards Bay. This can be extended to other ports by specific arrangement.
In light of the recent developments relative to Rule B attachments, this service should prove useful to claimants who are looking at alternatives for obtaining security.
As the after-effects of the global financial meltdown still linger, the South African arrest provisions provide a viable option for claimants looking to enforce, and/or seeking security for, their claims.
