  2. Developments in legislation.

    • The Protection of Personal Information Act, which will impact on how employers process their employees’ personal data, looks set to come into law next year. We will keep you updated in this regard.
    • Whilst the Department of Labour has indicated in the past that it is considering banning labour brokers, the more recent indications from the Department of Labour are that labour brokers will not be banned but that the industry will be subject to strict regulation. In terms of the current proposals being tabled by the Department of Labour, any individual who renders a service to the client from more than three months would be deemed to be employed by the client and not the labour broker.  In addition, clients of the labour brokers would be held jointly and severally liable for any unfair dismissal or unfair labour practice committed by the labour broker.  However, as of yet there is no clarity whether or not these proposals will become law. We will keep you updated of any legislative developments on this issue.
    • The Department of Home Affairs is attempting to clear its backlog of work permit applications and aims to do so by 31 December 2010.

Employment Law Update Seminars

These seminars are directed at HR and IR Practitioners, employment lawyers and in-house counsel.

These regular half-day seminars have been presented successfully for over 25 years.  This year we intend to present three seminars on 18 March, 22 July and 18 November 2011.

The purpose of the seminars is to communicate and engage with participants on the latest developments in employment law in South Africa.  The seminars are conducted in an informal and participative manner. 

Each seminar will typically cover the latest court and arbitration decisions that have an impact on employment law, and any recent or anticipated legislative developments.

Participants are given an opportunity through questions and discussions to understand and keep up to date with the dynamic changes that occur continuously in employment law in South Africa.  The focus is on the practical implications of these changes for employers and employees.

PRESENTERS

The seminars will be conducted by John Brand, Graham Damant, Talita Laubscher, Chris Todd and other members of Bowman Gilfillan's Employment Law Department. In addition, special guest speakers will be invited from time to time to make specialist contributions to the seminar.

VENUE

The seminars will be conducted at the offices of Bowman Gilfillan, 165 West Street, Sandton (entrance off Sandown Valley Crescent).
