Consumer Protection Act: Publication of proposed threshold

The Consumer Protection Act 68 of 2008 (CPA) will come into effect on 31 March 2010. In terms of the CPA, all persons who are regarded as consumers will enjoy various rights and protections to which suppliers of goods and services must give effect. While natural persons will always be regarded as consumers, juristic persons will only be treated as consumers in terms of the CPA where their annual turnover or asset value is equal to or less than the threshold set by the Minister of Trade & Industry in terms of section 6 of the CPA. On Monday, 11 October 2010, the Minister published a proposed determination regarding this threshold in the Government Gazette for public comment. The proposed threshold is R3 million. The determination also includes certain details regarding the manner in which an enterprise’s asset value and annual turnover is to be assessed. Comments on the proposed determination are required to be made and received by the Department of Trade & Industry by 31 October 2010. Comments may be submitted by e-mail or fax.
